SALIENT FORMALITIES OF A WILL
Writing out your Will is of utmost importance for purposes of securing your loved ones and safeguarding your legacy.
You have worked hard all your life to earn your assets, so now is the time to distribute your wealth in a way which benefits your family best.
The Master of the High Court has the ultimate discretion to accept or reject your Last Will and Testament.
In order for it to be accepted there are a number of formalities which must be adhered to :
* Your Will should be in writing;
* The person writing your Will cannot inherit;
* Your Will must be signed by two competent witnesses over the age of 14 years old (each page of the Will must be signed at the bottom);
* A person who signs your Will cannot inherit or be the Executor of your Will;
* Be sure to make provision in your Will which excludes the spouse of your beneficiary from inheriting (if they are married in community of property).
